Administration of Estates

Administrator-General’s Department]

| Administration by the Administrator-General becomes necessary when:-
- A person dies and leaves no Will and there are minor
beneficiaries
or
- where a Will does not name an executor
or
- the named executor has died or refuses to
act.
If this happens to you
take the following
steps:-
- Collect a Form
"Particulars for
Administrator General"
- This form must be completed then sworn to
and signed by a Justice of the Peace, Notary Public or Commissioner of
Oath;
The signed Form must now be
returned to the Administrator- General’s Department; accompanied by the
following supporting documents:-
- Death Certificate
- Birth Certificate(s) of children claiming a
benefit
- Marriage Certificate (where applicable)
- Proof of paternity (children born out of
wedlock);
the completed form must state
among other things:-
- names,
- ages and
- addressesof beneficiaries;
the extent of real property and personal property owned by the
deceased (giving description and estimated value.);
What Next?:- the Administrator General will apply to the Court for Letters
of Administration - which gives the legal authority to collect assets, pay debts
owed by the estate and distribute to beneficiaries.
Where a minor (person under the age of 18 years) is a
beneficiary the Administrator General holds his benefits on trust until he
attains majority (18 years)
